TERMS AND CONDITIONS

THESE TERMS AND CONDITIONS OF SERVICE CONTAIN IMPORTANT INFORMATION ABOUT YOUR LEGAL RIGHTS, INCLUDING YOUR AGREEMENT TO THE LIMITATION OF LIABILITY CLAUSE CONTAINED IN SECTION 9 OF THIS AGREEMENT.  

AS AN ENROLLED PARTICIPANT IN THE MY ONCOR ALERTS PROGRAM SPONSORED BY ONCOR ELECTRIC DELIVERY COMPANY LLC (“ONCOR”), YOU AGREE TO RECEIVE TEXT MESSAGES, PRE-RECORDED VOICE ALERTS, AND/OR EMAIL COMMUNICATIONS (“MESSAGES”) ABOUT ONCOR’S DELIVERY OF SERVICES AND SUPPORT TO THE PREMISE(S) YOU IDENTIFY AND/OR MATTERS THAT MAY AFFECT ONCOR’S DELIVERY OF SERVICE TO ANY SUCH PREMISE(S) AT THE PHONE NUMBER(S) AND/OR EMAIL ADDRESS(ES) YOU PROVIDE.  YOU AGREE THAT THE MESSAGES MAY BE SENT TO YOU USING AN AUTOMATIC TELEPHONE DIALING SYSTEM AND/OR A PRERECORDED OR ARTIFICIAL VOICE. YOU FURTHER AGREE THE MESSAGES YOU ARE AGREEING TO RECEIVE MAY INCLUDE, BUT MAY NOT BE LIMITED TO, COMMUNICATIONS REGARDING POTENTIAL AND ACTUAL ELECTRIC SERVICE DISRUPTION/OUTAGES, RESTORATION OF ELECTRIC SERVICE, EMERGENCY SITUATIONS, SAFETY AND WEATHER-RELATED INFORMATION, ENERGY CONSERVATION NOTIFICATIONS AND ACTIVITES, SERVICE REQUESTS FOR ANY SUCH PREMISE, VEGETATION MANAGEMENT AND OTHER FIELDWORK IN YOUR AREA, AND AVAILABLE ONCOR SERVICE-RELATED CUSTOMER TOOLS (“MY ONCOR ALERTS”).

BY ENROLLING IN THE MY ONCOR ALERTS PROGRAM AND BY USING MY ONCOR ALERTS AT ANY TIME, YOU ARE AGREEING TO THE MY ONCOR ALERTS TERMS AND CONDITIONS SET FORTH BELOW (“TERMS AND CONDITIONS”). THESE TERMS AND CONDITIONS MAY CHANGE FROM TIME TO TIME, AND ONCOR WILL POST ANY UPDATED TERMS AND CONDITIONS ON WWW.ONCOR.COM.  ALL CHANGES TO THE TERMS AND CONDITIONS WILL BE EFFECTIVE WHEN POSTED.

TO PARTICIPATE VIA TEXT MESSAGE, THE MOBILE PHONE(S) FOR WHICH YOU PROVIDE PHONE NUMBER(S) MUST BE ENABLED FOR TEXT MESSAGING. MESSAGE AND DATA RATES MAY APPLY WITH RESPECT TO EACH SUCH MOBILE PHONE.  TO PARTICIPATE VIA EMAIL, EACH SUCH EMAIL ADDRESS YOU PROVIDE MUST BE A VALID EMAIL ADDRESS.    MESSAGING AMOUNT AND FREQUENCY FOR TEXT, EMAIL AND/OR VOICE COMMUNICATIONS MAY VARY DEPENDING ON THE SUBJECT MATTER OF THE MY ONCOR ALERTS COMMUNICATIONS.  ADDITIONALLY, YOU UNDERSTAND AND AGREE THAT FOR EACH PHONE NUMBER AND EMAIL ADDRESS YOU PROVIDE, ONE OR MORE RESPONSES WILL BE RECEIVED IN RESPONSE TO EACH COMMUNICATION SENT TO ONCOR VIA ANY SUCH PHONE NUMBER AND/OR EMAIL ADDRESS AND THAT ONCOR MAY ALSO SEND PROACTIVE MY ONCOR ALERTS COMMUNICATIONS TO EACH PHONE NUMBER AND EMAIL ADDRESS YOU PROVIDE.

YOU HAVE THE ABILITY TO UNSUBSCRIBE, OPT-OUT OR CANCEL PARTICIPATION IN MY ONCOR ALERTS IN WHOLE OR IN PART AT ANY TIME BY VISITING WWW.ONCOR.COM, CALLING 1.888.313.6862, OR EMAILING ONCOR AT CONTACTCENTER@ONCOR.COM. IF YOU PROVIDED A MOBILE PHONE NUMBER TO RECEIVE MY ONCOR ALERTS VIA TEXT MESSAGE, YOU ALSO HAVE THE ABILITY TO OPT-OUT OF RECEIVING SUCH TEXT MESSAGES, AS WELL AS VOICE NOTIFICATIONS, AT SUCH MOBILE PHONE NUMBER BY TEXTING “STOP” TO 66267 (ONCOR). IF YOU SUBSCRIBE TO EMAIL ALERTS, YOU MAY OPT-OUT OF RECEVING SUCH EMAIL ALERTS BY CLICKING ON THE “UNSUBSCRIBE” LINK AT THE BOTTOM OF A MY ONCOR ALERTS EMAIL SENT TO YOUR ENROLLED EMAIL ADDRESS. IF YOU ARE A RECIPIENT OF MY ONCOR ALERTS VOICE NOTIFICATIONS AT YOUR RESIDENTIAL LANDLINE AND/OR A MOBILE PHONE NUMBER, YOU WILL HAVE THE ABILITY TO UNSUBSCRIBE TO SUCH VOICE NOTIFICATIONS AT SUCH PHONE NUMBER BY DIALING 2 DURING A NOTIFICATION CALL OR, IF PROVIDED IN SUCH VOICE NOTIFICATION, BY CALLING A DESIGNATED PHONE NUMBER.  IF YOU CHOOSE TO OPT-OUT OF MY ONCOR ALERTS VOICE OR TEXT NOTIFICATIONS TO A MOBILE PHONE NUMBER, PLEASE BE AWARE THAT SUCH OPT-OUT WILL EXTEND TO NON-EMERGENCY MY ONCOR ALERTS MESSAGES VIA BOTH VOICE AND TEXT TO SUCH MOBILE PHONE NUMBER UNLESS YOU INDICATE OTHERWISE.  FOLLOWING ONCOR’S RECEIPT OF A TEXT MY ONCOR ALERTS OPT-OUT COMMUNICATION FROM YOU, ONCOR MAY SEND YOU ONE TEXT MESSAGE TO THE MOBILE PHONE NUMBER INVOLVED FOR PURPOSES OF CLARIFYING AND CONFIRMING YOUR OPT-OUT COMMUNICATION.  IN THE EVENT THAT YOU HAVE PROVIDED A MOBILE PHONE NUMBER THAT IS ASSOCIATED WITH MULTIPLE PREMISES AND YOU CHOOSE TO OPT-OUT OF RECEIVING MY ONCOR ALERTS MESSAGES AT SUCH PHONE NUMBER, YOUR OPT-OUT WILL STOP NON-EMERGENCY MY ONCOR ALERTS MESSAGES VIA BOTH TEXT AND VOICE FOR ALL PREMISES ASSOCIATED WITH SUCH PHONE NUMBER UNLESS YOU CLARIFY OR LIMIT THE SCOPE OF YOUR OPT-OUT.  FOLLOWING ONCOR’S RECEIPT OF A TEXT MY ONCOR ALERTS OPT-OUT COMMUNICATION FROM YOU, YOU WILL RECEIVE ONE CONFIRMATION TEXT MESSAGE FROM ONCOR IN RESPONSE TO YOUR OPT-OUT MESSAGE, FOR THE PURPOSE OF CLARIFYING THE PREMISE(S) FOR WHICH YOU NO LONGER WISH TO RECEIVE ALERTS.

While My Oncor Alerts is complimentary and requires no purchase or fee for participation, message, voice and data rates may apply for each phone number you provide and may be billed on your phone bill or deducted from your prepaid balance.  Check with your carrier for details.  Message frequency may vary depending on My Oncor Alert program activity.  

You agree not to send or otherwise use My Oncor Alerts to make available content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, or contains hate speech.

You acknowledge that Oncor may or may not pre-screen any text message, email or voice content you provide, but shall have the right, without obligation and in its sole discretion, to pre-screen, refuse, or remove any content you make available, including content that violates these Terms and Conditions.

You agree to provide true, accurate and complete information about yourself during the My Oncor Alerts enrollment process, and to update this information promptly when it changes.  Additionally, you represent and confirm that you are the customary user or subscriber of and have the authority to enroll in the My Oncor Alerts program any and all phone numbers and email addresses you provide during the My Oncor Alerts program enrollment process and at any time thereafter.  You further represent that you are permitted to receive calls and, as applicable, text messages at the phone number(s) you have provided.  You agree to promptly alert Oncor whenever you stop using a phone number.  In the event that you provide a phone number for which you do not have authority to provide consent, you agree to defend and indemnify Oncor and/or its affiliates, agents, assigns, and service providers against any claims relating to My Oncor Alerts based on the consent that you have provided to receive such My Oncor Alerts.  If you provide any information that is untrue or inaccurate, not current, or incomplete, or if Oncor suspects that your information is untrue or inaccurate, not current, or incomplete, Oncor may, in its sole discretion, suspend or terminate such My Oncor Alerts enrollment and/or access or refuse current or future access.  Additionally, Oncor may, in its sole discretion and without notice, suspend or terminate such My Oncor Alerts enrollment and/or access or refuse current or future access if, in Oncor’s opinion, you have failed to comply with any of the provisions of these Terms and Conditions.

By sending text, email or voice communications to Oncor, you grant Oncor the perpetual, irrevocable, and fully sublicensable license to use, distribute, reproduce, modify, adapt, publish, translate, publicly perform, and publicly display any and all content provided by you to Oncor in your communications (in whole or in part) and to incorporate such content into other works in any format now known or later developed.

To unsubscribe from or opt-out of your participation in My Oncor Alerts at any time, please visit www.oncor.com, call 1.888.313.6862, or email Oncor at contactcenter@oncor.com. If you provided a mobile phone number to receive My Oncor Alerts notifications via text message, you also have the ability to opt-out of receiving such text messages, as well as voice notifications, at such mobile phone number by texting “STOP” to 66267 (Oncor).  If you subscribe to email alerts, you may also opt-out of receiving such email alerts by clicking on the “unsubscribe” link on a My Oncor Alerts email sent to your enrolled email address. If you are a recipient of My Oncor Alerts voice notifications at your residential landline and/or mobile phone number, you will have the ability to unsubscribe to such voice notifications at such phone number by dialing 2 during a notification call or, if provided in such voice notification, by calling a designated phone number.  If you choose to opt-out of My Oncor Alerts voice or text notifications to a mobile phone number, please be aware that such opt-out will extend to non-emergency My Oncor Alerts messages via both voice and text to such mobile phone number unless you indicate otherwise.  Following Oncor’s receipt of a text My Oncor Alerts opt-out communication from you, Oncor may send you one text message to the mobile phone number involved for purposes of clarifying and confirming your opt-out communication.  In the event that you have provided a mobile phone number that is associated with multiple premises and you choose to opt-out of receiving  My Oncor Alerts messages at such phone number, your opt-out will stop non-emergency My Oncor Alerts text and voice messages for all premises associated with such phone number unless you clarify or limit the scope of your opt-out.  Following Oncor’s receipt of a text My Oncor Alerts opt-out communication from you, you will receive one confirmation text message from Oncor in response to your opt-out message for the purpose of clarifying the premise(s) for which you no longer wish to receive alerts.  Please be aware that although you may opt-out of your participation in the My Oncor Alerts program, Oncor reserves the right to continue to communicate with you using contact information that you provided or provide in the future, to the extent allowed by applicable law, including to contact you regarding Oncor’s delivery of services and support to you or any matters that might affect such delivery and support or to contact you in emergency situations.

For additional information regarding Oncor’s use of information collected through My Oncor Alerts, please refer to Oncor’s Privacy Policy.  Without expanding or limiting Oncor’s use of information collected through My Oncor Alerts as described in these Terms and Conditions and Oncor’s Privacy Policy, Oncor uses the information you provide when you enroll and participate in My Oncor Alerts to provide My Oncor Alerts communications and to improve and enhance such communications.  Oncor may also share the information you provide with third parties who work with Oncor to provide Oncor’s content and services, including My Oncor Alerts communications.  Per Oncor’s Privacy Policy, you are deemed to consent to Oncor sharing the information you provide with any such third parties.  Such third parties will handle the information you provide when you enroll and participate in My Oncor Alerts in a manner that meets the commitments and obligations set forth the Privacy Policy.

Oncor is not responsible for any incomplete, undelivered, late, or misdirected My Oncor Alerts communications, including (but not limited to) if resulting from any form of filtering by any of the telecommunication carriers, service providers, or email servers associated with the phone number(s) and/or email address(es) you provided  or any service delivery errors, interruptions, or delays on the part of any of the telecom carriers or email or other service providers associated with the phone number(s) and/or email address(es) you provided.  Additionally, carriers are not liable for delayed or undelivered My Oncor Alerts communications, including (but not limited to) messages delayed or undelivered because your phone is not in range of a transmission site, there is not sufficient network capacity at a particular time, your equipment, terrain, your proximity to buildings, foliage, and weather. You acknowledge that My Oncor Alerts communications, including (but not limited to) urgent text messages and voice alerts, may not be timely received and that the telecommunication carriers do not guarantee that such messages will be delivered.

As an enrollee in the text message notification option of My Oncor Alerts, you will have the ability to send to Oncor and receive from Oncor certain text messages.

The carriers listed below are supported carriers for text messages. 

Major Carriers: AT&T, Verizon Wireless, Sprint, T-Mobile, U.S. Cellular, Alltel, Boost Mobile, and Virgin Mobile.

Minor Carriers: Alaska Communications Systems (ACS), Appalachian Wireless (EKN), Bluegrass Cellular, Cellular One of East Central IL (ECIT), Cellular One of Northeast Pennsylvania, Cincinnati Bell Wireless, Cricket, Coral Wireless (Mobi PCS), COX, Cross, Element Mobile (Flat Wireless), Epic Touch (Elkhart Telephone), GCI, Golden State, Hawkeye (Chat Mobility), Hawkeye (NW Missouri), Illinois Valley Cellular, Inland Cellular, iWireless (Iowa Wireless), Keystone Wireless (Immix Wireless/PC Man), Mosaic (Consolidated or CTC Telecom), Nex-Tech Wireless, NTelos, Panhandle Communications, Pioneer, Plateau (Texas RSA 3 Ltd), Revol, RINA, Simmetry (TMP Corporation), Southern Linc, Thumb Cellular, Union Wireless, United Wireless, Viaero Wireless, and West Central (WCC or 5 Star Wireless), Cellcom, CSpire Wireless.

YOU EXPRESSLY UNDERSTAND AND AGREE THAT YOUR PARTICIPATION IN MY ONCOR ALERTS IS AT YOUR SOLE RISK. MY ONCOR ALERTS IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. ONCOR AND ITS OWNERS, DIRECTORS, SUBSIDIARIES, AFFILIATES, OFFICERS, AGENTS, EMPLOYEES, PARTNERS, CONTRACTORS, CONSULTANTS,  LICENSORS, AND SUPPLIERS EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

ONCOR AND ITS OWNERS, DIRECTORS, SUBSIDIARIES, AFFILIATES, OFFICERS, AGENTS, EMPLOYEES, PARTNERS, CONTRACTORS, CONSULTANTS,  LICENSORS, AND SUPPLIERS MAKE NO WARRANTY THAT (A) MY ONCOR ALERTS WILL MEET YOUR REQUIREMENTS; (B) MY ONCOR ALERTS WILL BE UNINTERRRUPTED, TIMELY, SECURE, OR ERROR-FREE; OR (C) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF MY ONCOR ALERTS WILL BE ACCURATE OR RELIABLE.

YOU EXPRESSLY UNDERSTAND AND AGREE THAT ONCOR AND ITS OWNERS, DIRECTORS, SUBSIDIARIES, AFFILIATES, OFFICERS, AGENTS, EMPLOYEES, PARTNERS, CONTRACTORS, CONSULTANTS,  LICENSORS, AND SUPPLIERS SHALL NOT BE LIABLE TO YOU, YOUR AGENTS AND REPRESENTATIVES, OR ANY INDIVIDUAL OR ENTITY WITH WHOM YOU ARE AFFILIATED OR ON WHOSE BEHALF YOU HAVE ACTED, FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES OF ANY KIND, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES, EVEN IF ONCOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, RELATING TO THE TELEPHONE CONSUMER PROTECTION ACT, 47 U.S.C. §227 ET SEQ., OR ANY COMPARABLE STATE AND/OR FEDERAL LAW, RESULTING FROM THE USE OR THE INABILITY TO USE THE MY ONCOR ALERTS, UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA, THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF MY ONCOR ALERTS, STATEMENTS OR CONDUCT OF ANY THIRD PARTY WITH RESPECT TO MY ONCOR ALERTS, OR ANY OTHER MATTER RELATING TO MY ONCOR ALERTS.

Oncor reserves the right, in its sole discretion, to cancel or suspend any portion of or all of the My Oncor Alerts program, in whole or in part, for any reason, with or without notice to you.

These Terms and Conditions and Oncor’s relationship with you regarding My Oncor Alerts are governed by the laws of the State of Texas, without regard to its conflict of laws principles. You and Oncor agree to submit to the exclusive jurisdiction of any State or Federal court located in Tarrant County, Texas, and you and Oncor hereby waive any jurisdictional, venue or inconvenient forum objections to such courts.

These Terms and Conditions contain the entire agreement between you and Oncor regarding the use of My Oncor Alerts, and supersede all prior understandings related to use of My Oncor Alerts or any specific alert option within My Oncor Alerts. If any part of these Terms and Conditions is held invalid or unenforceable, that portion shall be construed in a manner consistent with applicable law to reflect, as nearly as possible, the original intentions of these Terms and Conditions, and the remaining portions shall remain in full force and effect.
